Understanding IndiaSilkArt’s Limitations as a Venue

IndiaSilkArt provides a venue for buyers to find, learn about, and enter into transactions with sellers around the world. It is important to note, however, that IndiaSilkArt is not a part of that transaction. By shopping on IndiaSilkArt, you understand that:

  1. You are not buying directly from IndiaSilkArt, but from one of the many talented sellers on IndiaSilkArt;
  2. IndiaSilkArt does not pre-screen sellers and therefore does not guarantee or endorse any items sold on IndiaSilkArt or any content posted by sellers (such as photographs or language used in listings or shop policies); and
  3. Each seller on IndiaSilkArt accepts different payment methods and has their own processing times, shipping methods, and shop policies.

As a member of the community, you have the opportunity to flag an item or a shop that violates any of IndiaSilkArt’s policies. Flagging is confidential.

Communicating with Other IndiaSilkArt Members

Interference
Interference occurs when a member intentionally interferes with another member’s shop in order to drive away their business. Interference is strictly prohibited on IndiaSilkArt. Examples of interference include:

  1. Contacting another member via IndiaSilkArt Conversations to warn them away from a particular member, shop, or item;
  2. Posting in public areas to demonstrate or discuss a dispute with another member; or
  3. Purchasing from a seller for the sole purpose of leaving a negative review.

Purchasing an Item on IndiaSilkArt

When you buy from a shop on IndiaSilkArt, you’re directly supporting an independent business, each with its unique listings, policies, processing times, and payment systems. By making a purchase from a seller on IndiaSilkArt, you agree that you:

  1. Have read the item description and shop policies before making a purchase;
  2. Have submitted appropriate payment for item(s) purchased; and
  3. Have provided accurate shipping information to the seller.

Leaving a Review of an Item

Reviews are a great way to learn about a seller’s items and reputation, help good sellers build a strong reputation, or help warn other buyers about a poor experience.

You can leave a review, including a one to five star rating and a photograph of your purchase, for 60 days after your item’s expected delivery date. The estimated delivery date is the purchase date + processing time + shipping time. You can edit your review, including the photograph, any number of times during that 60 day period.

By leaving a review or photograph, you acknowledge that:

  1. Your review and/or photograph and profile information will be publicly displayed on the seller's listing and review pages.
  2. Reviews and photographs may not:
    a. Contain private information;
    b. Contain obscene, racist, or harassing language or imagery;
    c. Contain medical drug claims;
    d. Contain advertising or spam;
    e. Be about things outside the seller’s control, such as a shipping carrier, IndiaSilkArt or a third party; or
    f. Undermine the integrity of the Reviews system.
  3. Extortion is not allowed on IndiaSilkArt. Any attempt to manipulate reviews through threats, intimidation, or bribery is considered extortion and is strictly prohibited on IndiaSilkArt. Examples of extortion include the following:
    a. A buyer leaves a negative review in an attempt to force the seller into providing additional items that were not agreed upon in the original transaction.
    b. A buyer leaves a negative review in an attempt to force the seller into providing a refund when a refund is not warranted. See this Help article for more information.
  4. Shilling is not allowed on IndiaSilkArt. Shilling is the fraudulent inflation of a shop’s reputation by use of an alternate account. The intent of shilling is to make a seller look more desirable by increasing the shop’s number of sales and overall review score. Not only does it violate our core value of transparency, but it is considered to be a deceptive business practice by the US Federal Trade Commission. Reviews must reflect the honest, unbiased opinions, findings, beliefs, or experience of the buyer. For more information on shilling, including examples, please see this Help article.

By uploading a photograph to IndiaSilkArt’s website or mobile app, you warrant that:

  1. You own the photograph or you have the rights or permission to use the photograph; and
  2. You understand that, as stated in IndiaSilkArt’s Terms of Use, IndiaSilkArt has license to use any content you provide to IndiaSilkArt.

Sellers may respond to reviews of three or fewer stars. Sellers’ responses to reviews must also comply with this policy. Sellers may hide photographs that they do not feel accurately represent their brand, or they may report reviews that violate our Terms of Use.

We reserve the right to remove reviews or photographs that violate our policies or Terms of Use.

Reporting a Problem with an Order or Returning an Item{##problems-and-returns}

IndiaSilkArt’s Case System

Although IndiaSilkArt is not directly involved in a transaction between a buyer and a seller, we provide a case system in the unlikely event your purchase from a seller does not go as expected. You can use IndiaSilkArt’s case system to come to a resolution with the seller in the event of a non-delivery, or if an item you receive is not as described in the listing. (Click here to learn how to open a case.) You can file a case under the following circumstances:

Non-Delivery
A Non-Delivery occurs when a buyer places an order and submits payment, but the seller does not ship the item or does not ship the item to the correct address. The following are examples of Non-Delivery cases:

  1. An item was never sent.
  2. An item was sent to an address that is not on the IndiaSilkArt receipt or was not verified through convos or USPS address verification.
  3. There is no proof that the item was shipped to the buyer’s address.

Not-as-Described
An item is Not-as-Described if it is materially different from the seller’s listing description or photos. Here are a few examples of Not-as-Described cases:

  1. The item received is a different colour, model, version, or size.
  2. The item has a different design or material.
  3. The item was advertised as authentic but is not authentic.
  4. The seller failed to disclose the fact that an item is damaged or is missing parts.
  5. A buyer purchased three items but only received two.
  6. The condition of the item is misrepresented. For example, the description at the time of purchase said the item was “new” and the item is used.

Not-as-Described cases can also be filed for late delivery. In order to qualify as late delivery, the buyer must provide proof that all of these conditions have been met:

  1. The item(s) were ordered for a specific date or event.
  2. A deadline was agreed upon by the buyer and seller.
  3. The item(s) are rendered useless after that date.

Ineligible Transactions
The following are not eligible for IndiaSilkArt’s case system:

  1. Items that have been purchased in person
  2. Intangible items, services, or prohibited items
  3. Transactions where payment is not made through IndiaSilkArt’s Direct Payments platform
  4. Items that are returned without a return agreement
  5. Items that have been altered, used, worn, or washed after receiving them
  6. Physical or tangible items that are not available for return because they have been destroyed or discarded by the buyer
  7. Items that are received after the agreed-upon delivery date due to shipping delays
  8. Cancelled transactions that have already resulted in a refund

Requesting a Cancellation

Only sellers may cancel transactions. Buyers may request that a seller cancel an order via IndiaSilkArt Conversations.

Returning an Item

Each seller has his or her own return policies, which should be outlined in their Shop Policies. Not all sellers accept returns. If you reside in the European Union, you may be entitled to a 14-day “cooling off period,” or a “right of withdrawal,” during which you may return an item for any reason. 1) Buyer Referrals Policy

Earning credits by referring your friends to shop on IndiaSilkArt's marketplace

IndiaSilkArt members may receive credits to be used on our website and mobile apps through IndiaSilkArt’s referral programmes. This Buyer Referrals Policy explains the requirements you need to meet in order to receive credits. You may only send referral invitations to friends or individuals who consent to receiving this type of message. You must comply with any applicable local laws.

This policy is a part of our Terms of Use. By participating in one of IndiaSilkArt’s referral programmes, you’re agreeing to this policy and our Terms of Use.

First-Time Buyers who receive a valid invitation may receive a credit towards their first purchase (“First-Purchase Credit”) on our website or mobile apps upon clicking a link to accept the invitation and registering as an IndiaSilkArt member or signing in to an existing IndiaSilkArt account. First-Time Buyers may apply the First-Purchase Credit towards a purchase on our marketplace using IndiaSilkArt’s Direct Checkout service (a “Qualifying Purchase”). A Qualifying Purchase may not be made from the First-Time Buyer’s own IndiaSilkArt shop or for a gift card, and may be subject to a minimum purchase requirement, which does not include tax, shipping or discounts. First-Purchase Credits may expire.

For every two Qualifying Purchases made by First-Time Buyers who accepted your invitations, IndiaSilkArt may add a Referral Credit to your IndiaSilkArt account within a commercially reasonable amount of time. You may be limited to receiving a maximum number of Referral Credits.

Credits are not transferable and may not be sold or exchanged for cash. If you or your friends do not comply with this policy, or do not follow the directions on the referral pages or valid invitations, you may not receive the applicable credits, and IndiaSilkArt will not be liable for any such non-compliance. Invitations may expire.

Participation in the referral programmes may be limited to IndiaSilkArt members located in certain countries or using certain currencies, and is void where prohibited by law. IndiaSilkArt reserves the right to modify or terminate the referral programmes at any time.

IndiaSilkArt reserves the right to cancel or rescind credits if it determines in its sole discretion that any party has violated this policy or IndiaSilkArt’s Terms of Use, including through any fraudulent or misleading referral activity (for example, by using multiple identities, email addresses or IndiaSilkArt accounts, otherwise providing false or misleading information, or conducting any kind of funny business) or if the party’s IndiaSilkArt account is closed for any reason.

2) Community Policy

IndiaSilkArt forums, teams and other community features

Community is at the heart of all we do at IndiaSilkArt. IndiaSilkArt members use community features to inspire each other, share knowledge, discuss ideas, and build personal and professional relationships. Community spaces include the Forums, Teams, Seller Handbook, and Treasuries.

This policy is a part of our Terms of Use. By using any of IndiaSilkArt’s community features, you’re agreeing to this policy and our Terms of Use.

Members who use any of the community features must be over 18 years old. In addition, to make sure that IndiaSilkArt continues to be a place that’s safe and respectful, the following policies apply to all community spaces:

  1. Respect other members’ privacy. Private or personally identifying information should not be shared in public areas of the site.
  2. Community tools or features may not be used to interfere with another member’s business.
  3. Be respectful towards other members. Community spaces may not be used to publicly disparage a specific member, shop, or item.
  4. Community spaces may not be used to harass other members. Similarly, content posted in community spaces may not promote, support, or glorify hatred.
  5. You may not publish or post threats of violence against others or promote or encourage others to engage in violence or illegal activity.

Forums

The Forums are divided into different sections, including Questions, Discussions, Bugs, Chitchat, and Promos. Please see this Help article to learn more about how to post in the Forums, including what type of content to post in each section.

Please keep in mind that the Forums are a public space, and that your posts are permanent (unless they are deleted by IndiaSilkArt for violation of our policies). Your posts may not disparage or violate the privacy rights of another member. Every member is responsible for what they post in the Forums. Forums moderators work to make the Forums a welcoming place for all, and may take certain actions to keep the Forums organised and helpful for everyone.

Teams

Teams is a community feature on IndiaSilkArt where you can connect with other members. Members use teams to share information about running a local business, get advice from experienced sellers, or gather to socialise. Buyers can browse Teams by theme or location to find items and shops that might interest them.

Teams are self-governing and self-moderating. Every team has one captain, and the captain may appoint one or more leader(s) to help run the team. A team may also have a charter detailing membership requirements and expectations for the team. Team leadership is responsible for enforcing the team's charter.

By using IndiaSilkArt’s Teams feature, you acknowledge that:

  1. IndiaSilkArt is not responsible for or involved in a team’s membership policies, dues, finances, or any other actions.
  2. Team forums may not be used to demonstrate or discuss disputes with other members or with IndiaSilkArt.
  3. A team may not use mature, profane, or racist language or images in the team's name, banner, or logo.
  4. A team may not be used for the sole purpose of redirecting traffic to another web location. IndiaSilkArt reserves the right to refuse links on any profile page or team page for any reason. Unsolicited promotion or advertisement from representatives or affiliates of outside services, websites, or other products is not allowed.
  5. Any use of the term "IndiaSilkArt," other IndiaSilkArt Trademarks or similar marks must comply with IndiaSilkArt’s Trademark Policy.
  6. Team moderation is the responsibility of the Team Captain. Team forums are subject to this Community Policy.
  7. IndiaSilkArt staff will not monitor third-party forums or other independent team sites.
  8. IndiaSilkArt will not mediate disputes between teams and outside parties, nor disputes between teams or team members.
  9. If a team chooses to use a dedicated item listing tag (also called a “team tag”), it must contain the word "team." IndiaSilkArt will not mediate disputes regarding use of team tags on item listings.

Treasuries

Treasuries are member-curated lists of items for sale on IndiaSilkArt. Treasuries may not be used for self-promotion or to discuss or disparage an individual member or shop.
